Introduction

The following Terms and Conditions define the terms and conditions under enmacc websites operated by Enmacc GmbH, Ridlerstr. 57, 80339 Munich (hereinafter ”enmacc”) are used.
The following Terms and Conditions apply to any visit to our freely accessible areas and to the registration area to obtain additional information (e.g. tutorial videos) via our platform (hereinafter ”websites”). By visiting our websites you accept these Terms and Conditions and the data privacy statement contained therein of Enmacc GmbH (paragraph 7) and undertake to comply with the latter. There is no entitlement to register for the purpose of receiving additional information. The conclusion of a separate user contract is required for using our platform. There is no entitlement to conclude a user contract. Our websites exclusively address entrepreneurs within the meaning of Section 14 of the German Civil Code [BGB], not consumers within the meaning of Section 13 BGB.

The contents of the enmacc websites (including but not limited to texts, logos, graphics, user interfaces, code, design) are copyrighted. The pages may only be duplicated for private use, changes may not be made and copies may neither be disseminated nor communicated to the public.

Registration obligations

You are solely responsible for all information provided by you at the time of registration. You provide assurance that the information that you have provided is true. You undertake not to deliberately issue the data of third parties as your own. Information that has been deliberately falsified or fraudulently provided, data of a third party provided without its consent may result in your access to the registration area being blocked and lead to legal consequences.

Prohibited use

You are prohibited from using the websites without having regard for applicable law and these Terms and Conditions: it is prohibited, at the minimum, to acquire unauthorised access to any part of the enmacc websites or to networks connected to an enmacc server. Any measures, including measures based on automated processes, which impair the infrastructure of the websites or enmacc networks or affect the proper operation of the websites, are prohibited. You may not use the websites or contents thereof for purposes prohibited by these Terms and Conditions or by law that violate the rights of enmacc or third parties.

Warranty

Any visit to our websites is solely at your own risk. You are solely responsible for damage, notably damage to your computer system, or for the loss of data caused by downloading data. We offer you our websites only ”as is” and ”as available”. This exclusion shall not apply where there has been a fraudulent concealment of a defect. We do not guarantee that our websites will be continually interruption and error-free, are always available or data and services are securely transferred. We cannot warrant for the correctness, completeness or up-to-datedness of the information accessed via our websites.

Limitation of liability

We do not accept any liability for any and all damage suffered after visiting our websites, irrespective of the legal ground, unless such damage is due to grossly negligence or wilful intent on our part, injury to life, limb or health or breach of material contractual obligations by us. Insofar as liability due to gross negligence or wilful intent on our part or the breach of material contractual obligations have materialised, our liability shall be limited to the typical damage that would have been reasonably foreseeable for us at the time of conclusion of the contract. Any liability on our part for consequential damages, consequential harm caused by a defect or foregone profit shall also be excluded. We do not accept any liability, inter alia, for constant access to our websites or the nature of the presentation. If our websites contain links to third-party websites, we accept no liability for the content of third-party websites. You are solely responsible for your use of third-party websites as well as the prior review of Terms and Conditions and data privacy statement of third-party websites.

These Terms and Conditions are subject to German law. The exclusive venue for all disputes arising or in connection with these Terms and Conditions is, to the extent permitted by law, the registered office of enmacc.
